Idaho Senate Passes HJR 4 to Protect State from Drug Legalization Efforts

Boise, ID – [March 14, 2025] – In keeping with the legislative priorities of Idaho Senate Republicans and the deeply held values of Idahoans, the Idaho Senate has passed House Joint Resolution 4 (HJR 4), taking a decisive step to safeguard the state from the increasing push toward drug legalization. This measure will allow Idaho citizens to vote in 2026 on a constitutional amendment that ensures only the Idaho Legislature has the authority to legalize marijuana, narcotics, and other psychoactive substances.


Across the nation, drugs—both legal and illegal—are devastating communities, tearing families apart, and overwhelming public resources. While some states have been misled into believing that legalization can mitigate the crisis, Idaho remains resolute in its commitment to resisting this dangerous trend. The notion that medical legalization is a harmless compromise has too often served as a Trojan horse for broad legalization later, with marijuana being the leading gateway in this process.


Marijuana today is far more potent than it was thirty years ago, with THC levels that have more than quadrupled, not to mention the rise of concentrated forms like dab pens. Mounting scientific evidence points to severe health risks, including addiction, violent psychosis, and developmental issues in children. Meanwhile, neighboring states that have embraced legalization are now struggling with rising crime, homelessness, and drug-related fatalities. Idaho, however, continues to stand firm against these influences.


Last month, the legislature passed House Bill 7, reinforcing Idaho’s position with mandatory fines for small-quantity marijuana possession. But the threat persists. The drug lobby is pouring money into efforts to sway Idaho voters, seeking to capitalize on the state’s agricultural resources and untapped market potential.


HJR 4 is a preemptive measure to protect Idaho’s future. By placing this constitutional amendment on the ballot, the legislature is ensuring that decisions regarding drug legalization remain in the hands of the elected representatives best equipped to assess the ongoing and evolving threats posed by drug proliferation. Idaho voters will have the opportunity to decide whether Section 26, Article III of the Idaho Constitution should be amended to state:


“Only the Idaho Legislature shall have power and authority to legalize the growing, producing, manufacturing, transporting, selling, delivering, dispensing, administering, prescribing, distributing, possessing, or using of marijuana, narcotics, or other psychoactive substances.”


The Idaho Senate Majority Caucus urges all citizens to thoroughly research the implications of drug legalization and to remain vigilant as the 2026 vote approaches. The ever-shifting landscape of the drug crisis demands strong and informed leadership, and Idaho must remain proactive in defending its communities, values, and way of life.
